A company is suing over claims T-Mobile has infringed upon its “You Should Be Here” registered trademark.
WorldVentures Holdings filed a lawsuit Oct. 14 in the Sherman Division of the Eastern District of Texas against T-Mobile USA Inc., citing trademark infringement.
According to the complaint, WorldVentures has used the trademark “You Should Be Here” in connection with its travel services since 2009 and registered it in November 2012. The complaint states WorldVentures has featured the phrase on its website along with encouraging clients to take photographs holding a sign bearing the phrase. WorldVentures says in July, T-Mobile began a campaign including a promotion to attract customers from other mobile service providers and a contest for a free vacation involving photographs bearing the same phrase. According to the lawsuit, WorldVentures made a demand upon T-Mobile on July 25 to cease using the phrase but T-Mobile refused. The defendant is accused of federal trademark infringement, federal trademark dilution and common law trademark infringement.
WorldVentures seeks an injunction against T-Mobile’s use of the phrase, actual and statutory damages, interest and attorney fees.
It is represented by attorneys Craig A. Harris and Jacob L. McBride of Hiersche, Hayward, Drakeley and Urbach in Addison.
