Over its 12-year life, Comcast Corp. v. Behrend produced dozens of rulings — by two district judges, four appeals court panels, and nine Supreme Court justices. The case thus gave the lawyers many chances to earn the judges’ trust in the lawyers’ word and to lose it.
In the next post, on January 25, I will talk about the role that trust played in Comcast Corp. v. Behrend and what it implies about the handling of all cases, big and small.
