Actor-Comedian Tracy Morgan Reaches Settlement with Walmart

In June 2014, a Walmart truck crashed into a limo carrying actor-comedian Tracy Morgan and several others on the New Jersey Turnpike. Morgan was seriously injured in the crash, suffering a severe brain injury, broken nose, leg, and ribs. He is still recovering. Another passenger, James McNair, was killed in the collision.

After Morgan filed suit against Walmart for the negligence of its driver causing the crash, the parties entered litigation, with Walmart initially refusing to acknowledge its driver’s fault and claiming that their driver had not broken any rules. An investigation by the National Transportation Safety Board (NTSB), however, revealed that the truck driver, Kevin Roper, was “driving 65 mph in the minute before” he crashed into Morgan’s limo van on the New Jersey Turnpike. The speed limit on that section of the highway is 55 mph and was reduced to 45 mph the night of the crash due to construction. Reports stated that the driver had been awake more than 24 hours straight before the crash.

Ultimately, in late May 2015, the parties reached a confidential settlement. Reversing course from its earlier obstructionist path, the company “took full responsibility for” the crash.
