After the accident, you need to write down exactly what took place as soon as you are able to do so. That includes the location of the accident, what time it took place, the contact information for all witnesses, and what types of injuries occurred. That information is going to be invaluable when it comes time to file your workers’ compensation claim. It will also help you if your case escalates into a legal battle.

Informing Your Company

In order to be compensated, you will need to file a report with your company as well as your state’s workers’ compensation board. When you file the report with your company, you only need to give them basic information. It might be tempting to blame another party or exaggerate your injuries, but that type of information could hurt you in the long run. Once you have informed your company, they should give you a form that can be sent to the workers’ compensation board.

In most states, an employee will be entitled to penalty money if their compensation checks aren’t delivered on time.

Following a workplace injury, you should not head back to work until you have been cleared by a doctor. You will probably meet with your medical team at least a few times a month after your accident, and they are going to carefully track your recovery. During that time, you can give your employer regular updates so that they will be ready for your return.
