No matter what side of a lawsuit you are on, it can be stressful. You probably have many questions and stresses as to how things are likely to turn out. To help ease your mind through your court proceedings we have prepared the top things you should know about three of the most common types of lawsuits.
Breach of Contract Lawsuits
One of the more common types of lawsuits is a breach of contract. A breach of contract lawsuit applies when a contract has not been followed in one or more ways. If the plaintiff can prove that the breach in contract resulted in damages, this will further help their case.
Popular defenses regard proving fault with the contract itself. Many oral agreements are easily argued because it leaves one person’s word against another’s. Indefinite contracts also pose a ready defense because they have no listed time frame as to when the contract went into effect or expired. In some cases, contracts can be voided and the case will be dismissed. For example, if there is a legitimate and obvious mistake on the contract, the defendant proves they were incompetent when signing the contract, an individual was illegally coerced into signing the contract, or the contract is grossly unfair to one party.
Wrongful Termination Lawsuits
If a person feels they have been illegally terminated from a job they may be able to file a wrongful termination lawsuit. Wrongful termination claims are valued by the amount of wage and benefit loss, as well as the emotional distress, resultimg from being fired. Employees who have been wrongfully terminated may be able to get their jobs back and have their lost wages compensated. While wrongful termination can be difficult to prove, these cases are often settled out of the courtroom, a benefit to both parties involved.
Personal Injury Lawsuits
Personal injury lawsuits cover a broad range of personal damage cases including car accidents, workers compensation claims, dog bites, and many more. Typically, these cases are easy for the plaintiff to prove that personal injury exists and the other party is responsible. The extent of personal injury can be more difficult to prove, though, and is typically heavily argued by the defendant. With the help of a personal injury attorney, you should be able to get the compensation you need to resume everyday life.
If you or someone you know may have a common lawsuit case, be sure to find and consult a lawyer to help with your unique situation. As professionals that study the law day in and day out, a hardworking attorney can be the answer you’re looking for to help you out of a less than desirable situation.
