Coin retailers swept up in litigation, punitive damages sought

rare_gold_coinsAmerican Eagle Reserve recently filed a pair of lawsuits against two former employees, alleging the defendant men are conspiring to steal customers and direct them to a competing company.


The suits and request for restraining orders were filed against William Fox, Richard Thibodeau and US Secure Coins, a defendant in both suits, on Feb. 26 in Jefferson County District Court.


According to the complaints, Fox and Thibodeau were former AER employees entrusted with confidential customer lists and special training.


Although both men signed contracts agreeing not to enter into competition with AER for an agreed period of time, they allegedly conspired with US Secure Coins before quitting to share trade secrets.


The men also allegedly contacted AER customers in an attempt to have them stop trading with the company and start buying with US Secure Coins.


The suits accuse the defendants of breach of contract, conspiracy to defraud and tortuous interference with a contractual relationship and harassment intended to disrupt and injure the business of AER.


In addition to injunctive relief, AER is suing to recover actual and punitive damages.
