How Victims Can Get the Most out of a Class Action Lawsuit

Originally published by Bob Kraft.

Class action lawsuits are a way for a group of harmed people to take action against a company. Rather than pursuing an expensive individual case, you can join in on the group effort. To make the most out of the class action lawsuit, be sure to follow these important action steps.

Submit the Required Documentation

In order to be a part of a class action lawsuit and receive part of a reward, you need to submit required documentation. Typically, you will need to provide your name, date of birth, street address, telephone number and email address. You will also need to explain your association with the product related to the class action lawsuit. For example, if the class action lawsuit is about a defective medical device, you may need to state when you received the device.

Provide Evidence

After submitting the required documentation and being added to the class action lawsuit, you may be contacted to provide additional evidence. For example, you may need to provide copies of your medical records stating that the device was inserted into your body and when it became defective or caused you bodily harm. You may need to show proof of what type of harm it caused you. In some cases, you may need documentation of the additional costs you incurred because of the device.

Claim Compensation

Once the class action lawsuit has been settled you will need to agree to the terms of the settlement. Professionals, like those at the D. Chadwick Calvert Law Office, know that joining the suit means you cannot make an individual lawsuit against the company or manufacturer of the product. If you accept the compensation, it will be sent to you and that will be the end of your involvement with the lawsuit. You will have no other legal claims against the manufacturer.

Opt Out

If you have a personal injury claim that your lawyer thinks is significant, consider opting out of the class action lawsuit. In a class action lawsuit, all claims are often compensated equally. If you had a severe injury, the compensation you get from the class action may not be as high as you could get through pursuing of an individual claim. However, your chances at compensation may be better overall with the class action lawsuit.

Class action lawsuits may help to protect your rights. By joining a group of claimants, you can help each other to succeed in court. Remember that you will receive the same level of compensation as everyone else who joins the lawsuit.
